Terms and Conditions for competitions and raffles organized by Factory Berlin

I Scope of Application

Factory Works GmbH, Rheinsberger Str. 76/77, 10115 Berlin (“Factory Berlin”, @factoryberlin on Instagram) is hosting an Instagram Halloween competition. The competition is in no way sponsored, endorsed or administered by or affiliated with Instagram. Participants submit their information to Factory Berlin and not to any third party. Any questions may be directed to Factory Berlin ([email protected]).

The entry into the competition will be deemed as acceptance of these conditions of participation. These T&Cs apply in addition to the information in the respective Instagram Post.

II Conditions of Participation

1. The competition is only open to Berlin residents and guests of the Berlin Tech Halloween Party 2022. The prizes will be awarded exclusively by Factory Berlin HQ after contacting the winners.
2. Participants must be 18 years or older. The competition is not open to employees of Factory Berlin.
3. The prize for this contest is a 3 month free Network + Campus Membership for each of the top 3 winners. Factory Berlin reserves the right to substitute the prize with another prize of equal value without notice.
4. To participate, the participant must post their costume for the Berlin Tech Halloween Party 2022 on Instagram. In their post they have to tag @factoryberlin. Winners will be selected from all posts found on Instagram. Factory Berlin Staff reserves the right to select the best costumes at its sole discretion and thereby determine the winners.
5. The competition will be held from 21:00 on 21.10.2022 until 00:00 (midnight) on 23.10.2022. Later entries to the contest will not be accepted.
6. The winners will be notified on 25.10.2022. Winners will be announced publicly on Factory Berlin’s Instagram channel and via private message to the winners themselves. If a winner does not get back to Factory Berlin within five (5) days of being notified or contacted, Factory Berlin reserves the right to revoke the winner’s prize and select a replacement winner.
7. As far as personal data of the participants are collected, processed or used in the context of the campaign and the competition, this is done exclusively for the purpose of carrying out the campaign and contacting the winners. Factory Berlin will use this data exclusively for contacting the participants and not for any other purposes and will not pass it on to third parties. The data may be further used by Factory Berlin for its own purposes to the extent permitted by law. The participant acknowledges and agrees that by publicly commenting / sharing the page / sharing the app with the hashtag, he/she may be identifiable (e.g. by account name or profile picture).
8. Factory Berlin reserves the right to modify or terminate this promotion, including the contest itself, at any time.
9. The competition and the conditions of participation are subject to German law and all disputes are subject to the exclusive jurisdiction of the courts in Germany. Legal recourse is excluded.
